One thumb up for 114
Oregon's new gun control law, passed directly by the people because the state legislature is so appallingly bad, has survived a constitutional challenge in federal court. Late last week (in a classic Friday news dump) Judge Karin Immergut in Portland rejected the arguments of the gun nuts that the new law, which was Measure 114, violates the Second Amendment, and some other amendments, to the federal Constitution.
But the new rules are still being held hostage by a state judge in Harney County, in the Greater Idaho section of the state, and so nothing has taken effect. And of course, Judge Immergut's ruling will be appealed to the Ninth Circuit, where public safety doesn't seem to be such a high priority these days, and then on to Harlan Crow's Supreme Court®.
Gun control is going to take 50 years to make a significant difference. And we can't even get started. The preachers of Oregon were forced to hold bake sales to get anything meaningful enacted, and now their painstaking work is tied up in court for months, probably years. How many times do we have to sing "We Shall Overcome"? Shame on Oregon. Shame on America.
My sense is that Roberts and Kavanaugh have had about enough of the crazies appearing before them for relief. This is all very reasonable stuff that should be upheld at all levels. I wonder if they might even pick off one or both of Trump's other appointees.
ReplyDeleteThis is my hope, at least.

Accordingly, I don’t see moderating there pen or sword in law as doing much, but worth a shot, heh?
This is a bit difficult to square with all the articles about public safety failures. If Portland is full of crime and can't/won't field an effective police force, self help is better than waiting to become a statistic.
ReplyDeletePortland, I dig it the most.

Odd. That criminal doesn't seem to obey any gun laws. Well at least there's new laws for those who do?
DeleteChicago has very strict gun laws and it is so peaceful there they are running out of body bags. London even stricter, so now knives and fire are the new gun. The problem is mental health and well being of which nobody gives a flying F until somebody goes cray cray.
ReplyDeleteLondon shmondon - wait till Portland really grasps the principles of the acid attack, we'll show 'em
